Briatore's future with the Longon club has been in doubt following the lifetime ban he was handed by the governing body of motorsport for his part in a race-fixing scandal during his time as Renault Formula One team boss.
The Italian has confirmed his intention to challenge the ban and the Football League will wait on the outcome before making any decision of their own. League rules prevent somebody banned from another sport from running a club.
A Football League statement read: "The Football League has noted the decision by Queens Park Rangers director Flavio Briatore to commence legal proceedings against the FIA in the French courts.
"The Football League will now await the court decision before taking any further action."
